Terms and Conditions

This agreement describes the terms and conditions applicable to your use of the ‘MyPCH’ portal.

1. Access to the ‘MyPCH’ portal

1.1  Eligibility

To access and use the ‘MyPCH’ portal, you must be a registered resident of one of Plymouth Community Homes (PCH) managed properties and have a valid account. This includes tenants, shared owners, leaseholders, garage/parking space licensees and freeholders.

1.2  Account Creation

To use the ‘MyPCH’ portal, you must provide accurate, current, and complete information during the account registration process.

2. User Responsibilities

2.1 Accurate Information

You agree to provide true, accurate, and complete information when creating or updating your account. You must promptly update any information that changes, such as your name, email address, phone number, or other personal details.

2.2 Account Security
On completion of your registration, you are responsible for always keeping your login credentials and password secure and for any activities that occur under your account. You are also responsible for ensuring that all users you have authorised to access the ‘MyPCH’ portal account on your behalf are aware of these terms of use and other applicable terms and conditions, and that they comply with them. PCH will not take responsibility for any unauthorised use of your account. If you know or suspect that anyone other than you knows your password or other security information, you must change your password as soon as possible. You are responsible for the inputting or safekeeping of any data, passwords or other information of any nature entered on the ‘MyPCH’ portal.

2.3 PCH has the right to disable your ‘MyPCH’ portal account at any time, if in our reasonable opinion you have failed to comply with any of these terms of use.

3. Services Provided through ‘MyPCH’ portal

This is not an extensive list and new services can be added to the ‘MyPCH’ portal at any time and without warning. Services can also be removed from the ‘MyPCH’ portal at any time and without warning.

3.1  Payment Services

The ‘MyPCH’ portal allows you to check your rent balance and any associated charges, and make payments for your rent and other associated charges. By using ‘MyPCH’ portal to make payments, you acknowledge that:

Payments will be processed through a third-party service provider

Payments are not considered complete until processed and confirmed by the payment service provider.

3.2   Repair Requests

The ‘MyPCH’ portal allows you to submit routine repair requests for your home. You agree to provide accurate and detailed descriptions of the issues to ensure timely service.

3.3 Emergency Repairs 

Emergency repairs must not be reported via the ‘MyPCH’ portal. These should be reported to PCH as stated on the PCH website.

3.3  Communication

By using the ‘MyPCH’ portal, you consent to receive communications, notifications, and updates related to your tenancy electronically via the portal. 

3.4  Document Access

You may use the ‘MyPCH’ portal to access and view documents relating to your tenancy and/or lease. These documents are for informational purposes only and may not be copied or shared without our consent.

3.5 Contact Forms

The ‘MyPCH’ portal allows you to submit contact forms. You agree to provide accurate and detailed descriptions of your enquiry to ensure a timely service. Any data submitted via our online forms is not secure and we cannot guarantee that information submitted will not be intercepted or modified, or that it will be received safely. 

3.6 Pre-Tenancy Application

For pre-tenants or tenants transferring to another PCH property, you may be asked to complete a pre-tenancy application through the ‘MyPCH’ portal. You agree to provide accurate information as required. 

4. Privacy and Data Protection

4.1 Your privacy is paramount to PCH, and we are committed to protecting your privacy online. Any personal information that is collected (with your knowledge) is solely for the purpose of communicating with you about an online query and/or your benefiting from the ‘MyPCH’ portal services.

4.2 By using the portal, you consent to the collection and processing of your personal data to provide and support the services we offer in accordance with PCH’s Privacy Policy. You may terminate your use of the portal at any time.

4.3 The Privacy Policy is incorporated into these Terms and Conditions by reference.

5. Intellectual Property

5.1 Ownership of Content

All content provided through the ‘MyPCH’ portal, including software, logos, text, graphics, and other materials, is the property of PCH or its licensors and is protected by intellectual property laws. You may not reproduce, modify, or distribute any content from the portal without prior written permission from us.

6. Termination of Access

6.1  Termination by Tenant

You may terminate your use of the ‘MyPCH’ portal at any time by using the ‘Delete My Account’ button in the portal. However, this will not affect your obligations under any existing tenancy agreement.

6.2 Termination by PCH

We reserve the right to suspend or terminate your access to the ‘MyPCH’ portal if:

You violate any terms of this Agreement

We determine that your use of the ‘MyPCH’ portal disrupts or interferes with the portal’s functionality or other users’ access.

7.  Limitation of Liability

7.1 No Warranty

The ‘MyPCH’ portal is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the ‘MyPCH’ portal will always be error-free or available.

7.2 Limitation of Liability

In no event shall PCH or its affiliates be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the ‘MyPCH’ portal, including but not limited to loss of services, data, or interruption.

8. Governing Law and Dispute Resolution

8.1 This Agreement will be governed by and construed in accordance with legislation in force in England and Wales.

 9. Amendments to the Terms and Conditions

9.1 We reserve the right to amend or update these Terms and Conditions at any time. When we make changes, we will update the effective date at the top of this Agreement. By continuing to use the ‘MyPCH’ portal after changes have been made, you agree to the updated Terms and Conditions. We may update, modify or may change the content on the ‘MyPCH’ portal at any time and without notice. Although we make reasonable efforts to update the information on the portal, we make no guarantees that the content on the portal is accurate, complete or up to date. We do not guarantee that the portal, or any content on it, will be free from errors or omissions. 

10. Miscellaneous

10.1 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

10.2 Entire Agreement

This Agreement constitutes the entire agreement between you and PCH with respect to the use of the ‘MyPCH’ portal and supersedes any prior agreements or understandings.
